Such a repetitive act was therefore not coincidental and indicated a motive to influence employees’ representation. The supervisor’s appearances around the union’s meeting could also have implications such as identifying members of the unions, based on their past unionism initiatives, and influencing elections results to favor some unions. The employer is also vicariously liable for the supervisor’s actions.
